Welcome to Cyber Scam Simulator, a cybersecurity awareness and training application developed and operated by Octopye Digital Designs. These Terms of Use ("Terms") govern your access to and use of the Cyber Scam Simulator mobile application ("App", "Service"), including all content, features, and functionality offered through the App. These Terms are effective as of February 2026.

Please read these Terms carefully before downloading, installing, or using Cyber Scam Simulator. By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any part of these Terms, you must immediately cease all use of the App and uninstall it from your device.

1 Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you ("User", "you", "your") and Octopye Digital Designs ("Company", "we", "our", "us"), a company registered in the United Kingdom, regarding your use of the Cyber Scam Simulator mobile application and all related services.

By downloading, installing, accessing, or using the App, you affirm that you have the legal capacity to enter into this agreement and that you accept and agree to be bound by these Terms. If you are using the App on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

If you do not agree with any provision of these Terms, you must not download, install, or use the App. Your continued use of the App following any modifications to these Terms shall constitute your acceptance of such modifications.

2 Description of Service

Cyber Scam Simulator is a comprehensive cybersecurity awareness and training application designed to educate users about digital, physical, and Internet of Things (IoT) security threats through interactive, scenario-based learning. The App provides the following features and content:

Free Features:

• Over 70 interactive training scenarios spanning 8 distinct threat categories, including phishing emails, SMS scams, phone call fraud, social media deception, website spoofing, ransomware attacks, physical security threats, and IoT vulnerabilities
• Realistic simulations that replicate real-world cyber attack techniques in a safe, controlled educational environment
• Structured educational courses covering foundational and intermediate cybersecurity topics
• Progress tracking, performance analytics, and achievement badges to monitor your learning journey
• Three selectable companion characters to guide you through training scenarios

Premium Features (subscription required):

• AI-generated dynamic training scenarios powered by OpenAI, providing unlimited unique and adaptive learning experiences
• SOC (Security Operations Centre) Analyst training challenges, including SIEM log analysis and firewall rule configuration exercises
• Endless scenario mode for continuous, randomised training sessions
• Access to advanced and expert-level content and threat categories

The App is available for download on the Google Play Store. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3 User Eligibility

You must be at least 13 years of age to download, install, or use Cyber Scam Simulator. By using the App, you represent and warrant that you are at least 13 years old and that your use of the App does not violate any applicable law or regulation.

If you are between 13 and 17 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf, and that you have their consent to use the App. Parents and guardians are responsible for supervising the use of the App by minors under their care and assume full responsibility for ensuring that the content is appropriate for the minor.

We do not knowingly collect personal information from children under the age of 13. If we become aware that a user under the age of 13 is using the App, we reserve the right to terminate their access immediately.

4 Account and Data

Cyber Scam Simulator does not require you to create an account or provide any personal information to use the App. No registration, email address, or login credentials are needed.

All training progress, achievement data, scenario completion records, and user preferences are stored locally on your device. This data is not transmitted to, stored on, or accessible by our servers. As a result, we cannot recover, restore, or transfer your progress data under any circumstances.

You are solely responsible for maintaining the security of your device and for any loss of progress data resulting from device malfunction, loss or theft of the device, operating system updates, app reinstallation, cache clearing, or any other factors outside our control.

5 Subscriptions and Payments

Cyber Scam Simulator offers premium features through a monthly subscription plan. By subscribing, you agree to the following terms:

• The premium subscription is priced at £3.49 per month, payable through the Google Play Store
• All payment processing is handled exclusively by Google Play. We do not directly collect, store, or process any payment or financial information
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the current period expires
• To cancel your subscription, navigate to your Google Play Store account settings, select "Subscriptions", locate Cyber Scam Simulator, and tap "Cancel subscription". Cancellation will take effect at the end of the current billing period
• No refunds will be issued for partial billing periods. Refund requests are subject to Google Play Store policies and must be directed to Google Play support
• We reserve the right to modify subscription pricing at any time. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle. Continued use of premium features after a price change constitutes your acceptance of the new pricing
• Free features of the App remain available without a subscription and will continue to function if your subscription expires or is cancelled

6 Acceptable Use

You agree to use Cyber Scam Simulator solely for lawful, educational purposes in accordance with these Terms. You expressly agree not to:

• Use the App, its content, or any techniques demonstrated within it for any unlawful, malicious, or unethical purpose
• Apply any knowledge or skills gained from the App to conduct actual phishing, social engineering, hacking, fraud, or any other form of cyber attack against any individual, organisation, or system
• Attempt to reverse engineer, decompile, disassemble, or extract the source code of the App or any part thereof
• Modify, adapt, translate, or create derivative works based on the App or its content without prior written consent
• Share, transfer, sublicense, or otherwise distribute your subscription access or premium content to any third party
• Reproduce, distribute, publicly display, or commercially exploit any content, scenarios, courses, or materials from the App
• Circumvent, disable, or otherwise interfere with any security-related features or digital rights management mechanisms of the App
• Use automated systems, bots, scrapers, or similar technologies to access or extract data from the App
• Introduce viruses, malware, or any other harmful code into the App or use the App to distribute such materials
• Misrepresent your identity or affiliation when using the App or impersonate any person or entity
• Use the App in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the App

Violation of these acceptable use provisions may result in immediate termination of your access to the App and may subject you to civil or criminal liability.

7 Educational Purpose and Responsible Use

Cyber Scam Simulator is designed and intended exclusively for educational and awareness purposes. All scenarios, simulations, and training materials within the App are created to help users recognise, understand, and defend against real-world cybersecurity threats in a safe, controlled environment.

The attack techniques, social engineering methods, phishing templates, and other security threat simulations presented in the App are reproduced solely for the purpose of training and awareness. They are not intended to serve as instructions, guides, or encouragement for conducting any form of malicious activity.

You acknowledge and agree that any misuse of the techniques, knowledge, or skills acquired through the App for malicious, harmful, or unlawful purposes is strictly prohibited and may constitute a criminal offence under the Computer Misuse Act 1990, the Fraud Act 2006, and other applicable United Kingdom and international laws. Octopye Digital Designs accepts no responsibility or liability for any misuse of the educational content provided within the App.

AI-generated scenarios are produced dynamically using OpenAI technology and are intended to provide diverse training experiences. While we take reasonable measures to ensure the appropriateness of AI-generated content, we cannot guarantee that all generated scenarios will be free from errors, inaccuracies, or inappropriate content.

8 Intellectual Property

All content, features, functionality, and materials available through Cyber Scam Simulator, including but not limited to the software code, application design, user interface, graphics, illustrations, character designs, animations, audio files, text, training scenarios, educational courses, logos, trademarks, and trade names, are the exclusive property of Octopye Digital Designs or its licensors and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Cyber Scam Simulator name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Octopye Digital Designs. You are granted no right or licence to use any of these trademarks without our prior written consent.

Your use of the App does not grant you any ownership interest in or to any content, features, or materials, nor does it grant you any intellectual property rights beyond the limited, non-exclusive, non-transferable, revocable licence to use the App in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App without our express written permission.

9 Disclaimer of Warranties

Cyber Scam Simulator is provided on an "as is" and "as available" basis without warranties or representations of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, Octopye Digital Designs expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the App will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components
• Any warranty that the training content will protect you from all cybersecurity threats or guarantee your safety online
• Any warranty regarding the accuracy, reliability, completeness, or appropriateness of AI-generated content or any other materials provided through the App
• Any warranty that the App will meet your specific requirements or expectations
• Any warranty that defects or errors in the App will be corrected

You acknowledge that no advice or information, whether oral or written, obtained from Octopye Digital Designs or through the App shall create any warranty not expressly stated in these Terms. Your use of the App is entirely at your own risk.

10 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Octopye Digital Designs, its directors, officers, employees, agents, partners, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages resulting from your use of or inability to use the App
• Damages resulting from any unauthorised access to or alteration of your data or device
• Damages arising from any content, scenarios, or materials accessed through the App
• Damages resulting from any third-party conduct or content in connection with the App
• Any loss or damage arising from the misuse of techniques or knowledge gained from the App

In no event shall our total aggregate liability to you for all claims arising from or relating to the use of the App exceed the amount you have paid to us, if any, during the twelve (12) months immediately preceding the event giving rise to the claim. If you have not made any payments, our maximum aggregate liability shall not exceed fifty pounds sterling (£50).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable United Kingdom law.

11 Changes to Terms

Octopye Digital Designs reserves the right to modify, amend, or update these Terms of Use at any time and at our sole discretion. When material changes are made, we will update the "Last updated" date at the top of this page and may notify you through one or more of the following methods:

• An in-app notification or banner displayed upon launching the App
• An update to this Terms of Use page on our website
• A notice posted on our website or within the App

It is your responsibility to review these Terms periodically for any changes. Your continued use of the App following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree with any changes, you must discontinue your use of the App immediately and uninstall it from your device.

12 Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, their subject matter, or their formation. However, if you are a consumer residing in another part of the United Kingdom, you may also bring proceedings in the courts of your country of residence.

In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting us at [email protected]. We will endeavour to resolve any complaint or dispute promptly and fairly. If an informal resolution is not achieved within thirty (30) days, either party may pursue formal legal proceedings as set out above.

13 Termination and Suspension

We reserve the right to suspend, restrict, or terminate your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, suspected fraudulent or unlawful activity, or conduct that we reasonably believe may cause harm to other users or to Octopye Digital Designs.

You may terminate your use of the App at any time by uninstalling it from your device and cancelling any active subscriptions through the Google Play Store. Upon termination, your right to use the App will cease immediately.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

14 Indemnification

You agree to indemnify, defend, and hold harmless Octopye Digital Designs, its directors, officers, employees, agents, contractors, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to reasonable legal fees) arising from or in connection with:

• Your use of or access to the App
• Your violation of any provision of these Terms
• Your violation of any applicable law, regulation, or third-party rights
• Any misuse of techniques, knowledge, or skills acquired through the App
• Any content or data you submit, post, or transmit through the App

This indemnification obligation shall survive the termination of these Terms and your use of the App.

15 Third-Party Services

The App may integrate with, rely upon, or contain links to third-party services, platforms, or content that are not owned or controlled by Octopye Digital Designs. These third-party services include, but are not limited to:

• Google Play Store for app distribution, subscription management, and payment processing
• OpenAI for the generation of AI-powered training scenarios (premium feature)

We have no control over and assume no responsibility for the content, privacy policies, practices, or availability of any third-party services. Your use of third-party services is governed by the respective terms and conditions and privacy policies of those services. We strongly recommend that you review the terms and privacy policies of any third-party services you access through the App.

Octopye Digital Designs shall not be liable for any loss or damage caused by or in connection with the use of or reliance on any third-party services, content, or resources.

16 Privacy

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which forms an integral part of these Terms. By using the App, you consent to the practices described in our Privacy Policy.

As detailed in our Privacy Policy, Cyber Scam Simulator stores all user data locally on your device. We do not collect, transmit, or store personal data on our servers. For information about how to delete your locally stored data, please visit our Data Deletion page.

17 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be replaced with a valid, enforceable provision that most closely reflects the intent of the original provision.

18 Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Octopye Digital Designs regarding your use of the Cyber Scam Simulator application. These Terms supersede all prior and contemporaneous agreements, proposals, representations, warranties, and understandings, whether written or oral, relating to the subject matter hereof.

No waiver of any provision of these Terms by Octopye Digital Designs shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
